Former Massey CEO Don Blankenhip’s appeal is being dealt a set-back. Massey was sentenced to a year in federal prison for violating health and safety standards before the 2010 Upper Big Branch Mine explosion. He has been appealing the case but the court on Friday refused his request for a full re-hearing. His attorney had already lost an argument that jurors were not properly instructed.
